What Is a Fiancé Visa?

A fiancé visa (K-1 visa) allows a foreign national engaged to a U.S. citizen to enter the United States for the purpose of getting married. After the wedding, the foreign fiancé can apply for a green card to stay in the U.S. permanently. While there are other ways to apply for a green card, this guide focuses on the K-1 visa for those planning to marry in the U.S.

The entire process from applying for the K-1 visa to getting a green card can take some time:

• K-1 Visa Processing: Around 8.8 months

The Fiancé Visa (K-1 Visa) Process

Step 1: Filing the Initial Petition (Form I-129F)

The journey begins with the U.S. citizen fiancé, also known as the "sponsor," filing Form I-129F, Petition for Alien Fiancé(e). This form proves that your relationship is genuine and that you intend to marry within 90 days of your partner's arrival in the U.S.

What You Need:

• Proof of U.S. citizenship (e.g., passport or birth certificate)

• A copy of your fiancé's passport

• Evidence of your relationship

• Statements of intent to marry within 90 days

• Passport-style photos of both fiancés

The filing fee for this form is $675. Once you've gathered all the documents, send them to U.S. Citizenship and Immigration Services (USCIS) using the correct mailing address.

Step 2: Applying for the Fiancé Visa

Once USCIS approves your petition, the process moves forward. Your fiancé will need to complete Form DS-160, the Online Nonimmigrant Visa Application, and attend a medical exam by an approved physician.

Documents for the Visa Interview:

• Confirmation page for Form DS-160

• Passport valid for at least 6 months beyond the intended travel

• Birth certificate

• Police certificates from countries where your fiancé has lived

• Sealed medical exam results

After the interview, the consular officer will decide whether to approve the visa. If approved, your fiancé will receive the K-1 visa and a sealed envelope with important documents.

Step 3: Traveling to the U.S. and Getting Married

Once your fiancé receives the visa, they have 6 months to travel to the U.S. Remember to bring the sealed envelope and passport with the visa to present to the Customs and Border Protection (CBP) officer upon arrival. You must get married within 90 days of your fiancé’s entry into the U.S. If not, your fiancé will need to leave the country.

Step 4: Applying for a Green Card

After the wedding, your new spouse can apply for a green card through the Adjustment of Status (AOS) process. This involves filing Form I-485, Application to Register Permanent Residence or Adjust Status.

Required Documents:

• Approval notice for Form I-129F

• Marriage certificate

• Passport with the K-1 visa

• Arrival/Departure Record (Form I-94)

• Affidavit of Support (Form I-864)

USCIS will review the application and might request additional information or schedule an interview. If approved, your spouse will receive a green card. If you've been married for less than two years, the green card will be conditional, lasting two years. Afterward, you can apply to remove the conditions and get a 10-year green card.
